for the amendment of Law No 544/2001 on free access to public information
The Parliament of Romania enacts this Law.
Sole Article - Law No 544/2001 on the free access to public information, published in the Official Journal of Romania, Part I, no 663 of 23 October 2001, is amended as follows:
1. Article 2(a) shall be read as follows:
"a) Public authority or institution means any public authority or institution using or managing public financial resources, any public organisation, national company and trading company under the authority of a public central or local authority to which the Romanian state or a territorial-administrative unit, as the case may be, is sole or majority shareholder;".
2. Article 12(1)(c) shall be read as follows:
"c) Information about commercial or financial activities, if its disclosure is detrimental to the intellectual or industrial property right, as well as to the fair competition principle, according to the law;".
This law was enacted by the Parliament of Romania, with the observance of the provisions of Art.75 and Art.76 (2) of the Constitution of Romania, republished.
